Singapore, Indonesia Supreme Courts ink memorandum to boost cross-border collaboration

The Supreme Courts of Singapore and of Indonesia have inked a Memorandum of Understanding to Enhance Cross-Border Communication and Cooperation in Cross-Border Insolvency Proceedings.

The MOU seeks to enhance insolvency and restructuring-related communication and cooperation via designated liaison points to improve coordination in resolving cross-border insolvency proceedings. The memorandum formalizes the communication processes across both courts and clarifies them for stakeholders; it also seeks to boost the efficiency of restructuring processes for companies being run in both countries.

This MOU builds on the Model Framework for Communication and Cooperation Between ASEAN Courts in Cross-Border Insolvency Proceedings greenlit at the 12th Council of ASEAN Chief Justices Meeting last November. It follows Singapore and Indonesia’s 2023 bilateral agreement for judicial cooperation.

The new MOU was signed on March 30 on the sidelines of the first Judicial Well-Being Workshop for ASEAN Judges, which was held in Bali. The signatories were Singapore chief justice Sundaresh Menon and Indonesia chief justice Dr. H. Sunarto.

Indonesia is the newest ASEAN jurisdiction to collaborate with Singapore on cross-border insolvency proceedings. Singapore has worked with the Federal Court of Malaysia in line with the 2021 protocol on court-to-court communication and cooperation in cross-border corporate insolvency matters; it has also collaborated with the Supreme Court of the Philippines through the 2025 MOU to enhance cross-border communication and cooperation in cross-border insolvency proceedings.

On February 10, the Supreme Court of Singapore signed an MOU for judicial cooperation with the Supreme Court of the Kingdom of Cambodia – the first bilateral judicial cooperation agreement between these jurisdictions. The memorandum aimed to boost the exchange of knowledge and experiences between Singapore and Cambodia and drive discussions on matters of common interests such as the electronic filing of court documents, case management systems, resourcing, and supporting and building capacity for using these systems.

The MOU was signed during a two-day visit by Menon to the Supreme Court of Cambodia. He was accompanied by Aidan Xu, judge in-charge of transformation and innovation, and Juthika Ramanathan, chief executive of the Office of Chief Justice.
