The three-day judicial exchange also tackled the role of courts in sustaining public trust

The Supreme Court of Canada recently discussed topics like the rule of law and judicial independence with the Supreme Court of the United Kingdom at a three-day judicial exchange.

The delegations traded perspectives on the importance of public communications and outreach activities. Moreover, they tackled administrative law developments, statutes interpretation, how courts help to sustain public trust, and complex legal issues in modern democratic societies.

Canada chief justice Richard Wagner led the SCC delegation, which consisted of justices Andromache Karakatsanis, Suzanne Côté, and Mahmud Jamal. The UK Supreme Court delegation comprised Supreme Court president Robert Reed, David Lloyd-Jones, Vivien Rose, and Ingrid Simler.

“These judicial exchanges provide a unique opportunity for our respective courts to work together on issues of mutual interest,” Wagner said in a statement. “The visit this week also highlighted the strong and enduring relationship between the Supreme Court of Canada and the Supreme Court of the United Kingdom. It reflected a shared commitment to the rule of law and to maintaining open dialogue between our Courts as we are facing similar challenges in a rapidly evolving world.”

The exchange was held in Ottawa and took place from June 1-3. The UK Supreme Court delegation also connected with leaders from the National Judicial Institute and the Office of the Commissioner for Federal Judicial Affairs.

Moreover, the delegation conducted a fireside chat with SCC law clerks and staff.

Last month, England and Wales’ lady chief justice, Sue Carr, visited Canada and sat down with prime minister Mark Carney to discuss how ongoing cooperation can strengthen legal institutions. She also met with Wagner, the Ontario chief justice, the Federal Court of Appeal chief justice, and the Ontario Superior Court of Justice chief justice.

During her visit, Carr spoke at the Ontario Superior Court of Justice Spring Conference.

“Suffice to say that we particularly value our long-term relationship with Canada, who has proven herself a constant, reliable, stable presence; sharing our core social values over many years,” she said in her address. “By learning together, sharing ideas and best practice, as well as honestly reflecting on failures, we can strengthen the British and Canadian judiciaries. There is much to learn from both jurisdictions.”

In 2023, Wagner met with then-Supreme Court of Japan chief justice Saburo Tokura in a virtual session to discuss collaboration opportunities. The chief justices addressed the value of updating and digitalizing court business for accessibility and efficiency.
