BC Provincial Court welcomes new judges Michael Fortino and Michael Libby

The Government of British Columbia has appointed Michael Fortino and Michael Libby as judges of the Provincial Court.

Michael Fortino started his legal career as a criminal defence lawyer before becoming crown counsel, where he specialized in major crimes. In 2022, he was appointed deputy regional crown counsel for the Fraser region. Fortino's extensive public service includes more than two decades as a Canadian Armed Forces reservist, during which he mentored staff involved in the cadet program. He also played a key role in developing the Surrey Inns of Court program, which helps young lawyers enhance their advocacy skills. His dedication to training and mentorship earned him a BC Prosecution Service award in 2022, and he was a finalist for a Premier’s Excellence Award as an emerging leader in the BC Public Service.

Michael Libby brings a broad range of legal experience, including criminal law, corporate and commercial litigation, tort and insurance defence, and mediation. Libby became a partner at his law firm in 2010 and was a national managing partner from 2018 to 2022. In addition to his legal practice, Libby co-authored several law textbooks covering subjects like the Motor Vehicle Act and sports and cannabis liability law. For over 20 years, he has served as a program coordinator and faculty member for the British Columbia Inns of Court program, where he mentors 50 junior barristers annually. In recognition of his legal expertise and contributions, Libby was appointed King’s Counsel in 2023.

These appointments follow a careful selection process overseen by the Judicial Council of British Columbia, a body composed of judges, lawyers, and non-legal professionals. Candidates are evaluated based on the court’s needs, the diversity of the judiciary, and their legal expertise. The provincial cabinet makes the final appointments through an order-in-council.

Both Fortino and Libby are expected contribute to the Provincial Court's mission to ensure fair and efficient access to justice. While judges are located in specific regions, they regularly travel and use technology like video conferencing to meet the changing needs of communities throughout the province.

Fortino and Libby will assume their roles as Provincial Court judges effective September 27.
